TERMS & CONDITIONS

The agreement between you and Sure Swift Express Delivery Ltd

Operated by Sure Swift Express Delivery Ltd

Effective date: 1 October 2026 · Version 1.0

1. Introduction

These Terms and Conditions (“Terms”) govern your access to and use of the Sure Swift Express Delivery platform, including our website, mobile application, and related services (together, the “Platform”). By creating an account, requesting a delivery, or otherwise using the Platform, you agree to these Terms. If you do not agree, please do not use the Platform.

These Terms work together with our Privacy Policy and our Refund Policy, which are separate documents and form part of your agreement with us.

Legal basis (Ghana)

These Terms are framed to align with: the Companies Act, 2019 (Act 992); the Electronic Transactions Act, 2008 (Act 772); the Data Protection Act, 2012 (Act 843); the Sale of Goods Act, 1962 (Act 137); and applicable Bank of Ghana payment-services rules.

Ghana is also progressing new e-commerce legislation expected to strengthen online-consumer rights. Sure Swift will update these Terms as the law changes.

2. Who we are

Sure Swift Express Delivery Ltd is a limited liability company incorporated in Ghana under the Companies Act, 2019 (Act 992). We operate a technology platform that connects customers who need items delivered with independent delivery partners (riders, drivers, and vendors) who carry out those deliveries, nationwide in Ghana.

3. The nature of our service

Sure Swift provides a booking, matching, and payment Platform. The actual transport and delivery of items is performed by independent delivery partners who are not employees of Sure Swift. Sure Swift is not the sender, the seller, or the owner of the items being delivered.

4. Eligibility & accounts

5. Booking a delivery

When you request a delivery, you provide pickup and drop-off details, a description of the item, and the recipient’s contact information. A booking becomes a binding order when Sure Swift confirms it and (where applicable) a delivery partner accepts it. You are responsible for the accuracy of the address and item details; failed deliveries caused by wrong information may incur additional charges.

6. Pricing

Sure Swift charges primarily on a per-distance basis, with additional factors where applicable. All charges are shown to you before you confirm a booking, in Ghana Cedis (GH₵).

Charge type How it works
Distance-based fare Calculated on the distance between pickup and drop-off points.
Intercity / courier deliveries Priced according to route, distance, and parcel size/weight.
Item size / weight Larger or heavier items may attract additional charges, shown before confirmation.
Waiting / surge / special handling Any such fees are disclosed before you confirm.
Taxes & levies Applicable taxes and statutory levies are included or shown as required by law.

No hidden charges: you will always see the total price before you confirm.

7. Delivery & logistics

7.1 Coverage

Sure Swift operates nationwide in Ghana, offering local (within-city) deliveries and intercity courier-style deliveries. If we cannot fulfil a booking, we will tell you and not charge you for an unfulfilled service.

7.2 Delivery times

Time estimates depend on distance, traffic, weather, partner availability, and the nature of the item. Any time shown is a good-faith estimate, not a guarantee, unless we expressly offer a guaranteed-time service.

7.3 Pickup & handover

7.4 Failed deliveries

A delivery may fail if the recipient is unavailable, the address is wrong, delivery is refused, or access is unsafe. We attempt contact; re-delivery or return may be arranged and may attract an additional distance-based charge.

7.5 Unclaimed or undeliverable items

If an item cannot be delivered or returned after reasonable attempts within 14 days, Sure Swift will contact the sender for instructions. Where an item remains unclaimed beyond 30 days, we may store, return, or dispose of it in accordance with the law, and may charge reasonable storage or return costs. Perishable or unsafe items may be dealt with sooner where necessary.

7.6 Liability for loss or damage

Sure Swift takes reasonable care in operating the Platform and selecting delivery partners. Because deliveries are physically carried out by independent partners:

Nothing excludes liability that cannot lawfully be excluded under Ghanaian law, including for death or personal injury caused by negligence.

7.7 Force majeure

Neither Sure Swift nor a delivery partner is liable for delays or failures caused by events beyond reasonable control, including natural disasters, severe weather, civil unrest, strikes, road closures, network or power outages, or government action.

8. Prohibited & restricted items

You may not send, and delivery partners may refuse or report, any item whose carriage is unlawful or unsafe, including:

You are solely responsible for ensuring the legality of what you send, and you indemnify Sure Swift against losses arising from your breach of this clause.

9. Your responsibilities

10. Acceptable use

To keep Sure Swift safe and fair, you must not:

We may suspend or terminate accounts that breach this policy, refuse service, withhold or reverse payments where fraud is involved, and report unlawful activity to the authorities.

11. Payments

We accept Mobile Money (MoMo), Visa/Mastercard cards, and Cash on Delivery (COD) where offered. With COD, the delivery partner collects the cash and remits it to Sure Swift’s central financial office, which then settles with the vendor or sender. Delivery partners do not pay vendors directly — all COD funds flow through Sure Swift. Card and mobile-money payments are processed through licensed payment service providers operating under Bank of Ghana oversight. Sure Swift does not store your full card number or mobile-money PIN. Full details of payments, cancellations, and refunds are set out in our separate Refund Policy.

12. Privacy

We handle personal data in line with the Data Protection Act, 2012 (Act 843). Sure, Swift is a registered Data Controller with Ghana’s Data Protection Commission.

13. Intellectual property

The Sure Swift name, logo, Platform, and content are owned by Sure Swift or its licensors and are protected under Ghanaian intellectual-property law. You may not copy, modify, or reuse them without our written permission.

14. Changes to these Terms

We may update these Terms from time to time, including to reflect changes in Ghanaian law. We will post the updated version with a new effective date and, where changes are material, give reasonable notice through the Platform. Continued use after changes take effect means you accept the updated Terms.

15. Governing law & disputes

These Terms are governed by the laws of the Republic of Ghana. Please contact us first so we can resolve any complaint quickly (see Section 16). If a dispute cannot be resolved, it may be referred to mediation or arbitration seated in Accra, Ghana, or to the competent courts of Ghana. Nothing in these Terms removes any right you have under mandatory Ghanaian consumer-protection law.
